Funded Simulated Account Agreement

About This Document
This document forms part of your legal relationship with FUNDED IQ LLC. In this document, we, us, and our mean FUNDED IQ LLC. You and your mean you as the person this document applies to. Read this document together with the General Terms and Conditions and any Product Schedule, programme terms, agreement, or policy incorporated into your Order or account.
FundedIQ provides simulated CFD evaluation and funded-account services. FundedIQ is not a broker, deposit-taker, custodian, or investment adviser, and the balances shown in FundedIQ accounts are not customer funds.
1. Parties and Acceptance Record
This Agreement is between FUNDED IQ LLC and you, the verified trader identified in the electronic Acceptance Record. The Acceptance Record includes your legal name, profile identifier, contact details, Order and challenge identifiers, funded account identifier, Product Schedule version, Agreement version, acceptance timestamp, and electronic-signature evidence. It forms part of this Agreement.
2. Account Appointment
We appoint you, on a personal and revocable basis, to operate the funded simulated account described in the Product Schedule. You accept that the appointment is limited to the simulation, creates no authority to bind us, and does not make you an employee, worker, partner, agent, fiduciary, franchisee, or manager of client assets.
3. Conditions Before Issue
We issue credentials only after successful KYC and sanctions screening, verified payment ownership, approval of the qualifying evaluation where applicable, and execution of this Agreement. We may require refreshed checks before issue if material information changes.
4. Simulated Account
The nominal balance, equity, positions, fills, profit, and loss are simulated accounting entries. They are not owned by you and are not redeemable. We decide whether, when, and how to use aggregate or individual trading information for risk management, research, hedging, or separate proprietary activity. You have no interest in or claim over any external transaction.
5. Personal Performance Obligation
You must make every trading decision personally and retain control of the account. Credentials may not be shared. No third party may trade, manage, pass, rent, mirror, or control the account. Personal risk-management software, a personal VPS, and permitted strategy tools may be used only within the Product Schedule and Trading Rules and must not transfer decision-making or access to another person.
6. Applicable Rules
The Product Schedule and captured Trading Rules are incorporated into this Agreement. They state risk limits, drawdown method, trading permissions, exposure limits, inactivity, consistency rules, reward share, reward cycle, and other account terms. You must monitor the dashboard and allow a prudent margin from hard limits; display latency does not change the authoritative calculation.
Where this Agreement grants a wider right to us than the Trading Rules or the Performance Reward Policy, this Agreement prevails.
7. Performance Reward
Subject to this Agreement, we may pay you the stated share of Eligible Net Simulated Profit for an approved Reward Period. The calculation, request procedure, balance adjustment, review, deductions, and payment are governed by the Performance Reward Policy. The reward is contractual consideration for compliant simulated performance and associated analytical value; it is not a withdrawal, salary, investment return, or share of a live account.
No reward is earned, accrued, vested, or owed until the review is complete and we approve the request in writing. A balance, profit figure, reward estimate, or dashboard message is a conditional calculation only and creates no right to payment. We may reject a request in whole or in part, and may re-verify any request or approved reward at any time before payment is complete.
8. Reward Conditions
Every condition below must be satisfied, in our reasonable judgement, at the cut-off and again at the time of payment. We decide whether a condition is met on the balance of the available evidence.
- The account remains active and no hard breach occurred before the cut-off
- All positions and orders are in the state required by the Product Schedule
- The minimum time, profit, consistency, and request thresholds are met
- KYC, sanctions, payment ownership, tax, and payout-destination checks are current
- The profit results from your own genuine, discretionary trading decisions made personally on the account
- You have answered every compliance request under clause 15 accurately and within the stated period
- No prohibited or abusive conduct described in clause 9, manipulation, technical exploitation, or reward fraud is established or under review
- No amount is owed by you to us under this Agreement or any other FundedIQ agreement
9. Prohibited and Abusive Conduct
The Trading Rules and Prohibited Practices are incorporated into this Agreement. In addition, and without limiting them, we treat each of the following as abusive conduct under this Agreement, whether it takes place on this account, on another FundedIQ account, or through another person:
- Operating, controlling, funding, or benefiting from more than one FundedIQ profile, or coordinating trades across accounts held by different people, households, groups, or communities, including opposite, offsetting, or hedged positions across accounts or across firms
- Copy trading, mirror trading, signal execution, trade copiers, account management, account passing, account sharing, renting or selling access, or letting any other person trade, direct, or influence the account
- Exploiting a price feed, quote, latency, connectivity, order-routing, execution, swap, commission, platform, or data error, or any pricing that differs from the underlying market, including arbitrage against another platform or broker
- Tick scalping, burst or high-frequency order placement, order flooding, quote stuffing, or any pattern designed to overload, probe, or reverse-engineer the platform or its risk controls
- Gambling-style behaviour, including all-in positions, martingale, grid, or doubling strategies, oversized exposure around news or in thin liquidity, or any approach that depends on chance rather than skill to reach a target or a reward
- Trading during a restricted news window, on a restricted instrument, at a restricted time, or from a restricted location where the Product Schedule or Trading Rules restrict it
- Using an expert advisor, bot, script, or automation that the Product Schedule does not permit, that is not your own, or that copies or reproduces another person's trades
- Misstating identity, residence, age, or eligibility; using a VPN, proxy, virtual machine, or remote desktop to conceal location, identity, or a third-party operator; or providing false, altered, or borrowed identity, payment, or ownership evidence
- Chargeback, refund, discount, promotion, referral, or affiliate abuse, including self-referral and collusive purchasing
- Any other conduct that, in our reasonable opinion, is inconsistent with genuine personal trading skill, defeats the purpose of the evaluation or funded programme, or abuses the programme, its rules, its promotions, or its pricing
- Attempting, assisting, encouraging, or benefiting from any of the above, or failing to report it after becoming aware of it
We decide whether conduct is abusive on the balance of the available evidence, which may include platform records, device fingerprints, network and IP data, behavioural and statistical analysis, payment data, and information from other traders, providers, or affiliates. Intent is not required; the effect of the conduct is enough. A common strategy, a personal VPS, or profitability alone is not proof of abuse, but a pattern that matches known abuse may be treated as abuse until you show otherwise. A linked person means any person or profile that shares identity, payment, device, network, household, or trading-control links with you.
10. Rights on Suspected Abuse and Suspension
If we have reasonable grounds to suspect abusive conduct, a hard breach, a compromised credential, a sanctions hit, a fraud or payment-reversal signal, a provider error, or a material data inconsistency, we may, at our sole discretion and with or without prior notice, do any one or more of the following:
- Suspend or restrict trading, access, or specific instruments, tools, or permissions on this account or on any other FundedIQ account held by you or a linked person
- Close, reduce, or reverse open simulated positions and cancel pending orders
- Freeze, withhold, delay, reduce, or deny any pending or future reward, including a reward for a period or account not directly affected by the conduct
- Treat some or all simulated profit as ineligible and adjust the balance, equity, or profit ledger accordingly
- Reset, cancel, or close the account and refuse a replacement or new account to you and to any linked person
- Recover any reward already paid that is later found ineligible, by offset against any amount otherwise payable or by requiring repayment within fourteen calendar days of notice
- Terminate this Agreement under clause 16
A suspension or hold is not a final adverse finding. We will review the evidence, normally within thirty calendar days, and may extend that period where the review is complex, evidence is awaited from a provider or authority, or you have not answered a request. No reward is due while a review is open, and you have no claim for any delay, loss, or missed opportunity caused by a suspension or review made in good faith. We will communicate the outcome unless disclosure is legally restricted or could prejudice fraud, sanctions, security, or legal controls. You may appeal a final decision under the Complaints and Appeals Policy.
11. Denial and Recovery of Rewards
Where abusive conduct, a hard breach, or a material misstatement is established, no reward is payable for the Reward Period in which it occurred or for any later period on the same account, regardless of when we discover it. Profit generated in whole or in part by the conduct is forfeited. We may also withhold rewards on other accounts held by you or a linked person while we review whether the conduct affected them.
Any reward paid on the basis of information later found to be false, incomplete, or misleading, or on activity later found to be abusive, is repayable on demand. We may set off any such amount against any reward, refund, credit, or other sum otherwise payable to you under any FundedIQ agreement.
12. No Guarantee of Rewards or Continuation
Nothing in this Agreement guarantees that a reward will be earned, approved, or paid, that the account will continue for any period, or that a scaling plan, higher share, or further account will be offered. We may change reward schedules, request windows, minimums, payment methods, and Trading Rules prospectively by notice through the dashboard, email, or website; a change does not affect a reward already approved. We have no liability for a reward that is not earned or approved, for lost profits, or for lost opportunity, and you have no claim for any expected or projected reward.
13. Data and Strategy Information
We own the platform records and may collect, analyse, aggregate, reproduce, model, and use account activity to operate the service, enforce rules, improve risk systems, and inform proprietary decisions. You retain ownership of original materials you submit but grant us a worldwide, non-exclusive, royalty-free licence to use them for those purposes. We will not publicly identify you with a strategy without your permission, except where law permits or requires disclosure.
14. Confidentiality
Non-public account credentials, risk models, investigation methods, security controls, and information expressly marked confidential must not be disclosed or misused. This does not prevent disclosure to a professional adviser under confidentiality, to an authority, or where law requires. Public programme rules and your own account history are not confidential merely because they appear in a dashboard.
15. Compliance Review
We may request trading explanations, platform logs, proof of device control, proof of payment or payout ownership, tax forms, source-of-funds information, or refreshed identity evidence. Requests must be proportionate to the identified risk. You must respond accurately within the stated reasonable period.
Unless the request states a longer period, you must respond fully within seven calendar days. If you fail to respond, to respond completely, or to supply evidence that we can verify, we may treat the matter as unresolved, suspend the account, withhold or deny the affected rewards, and, where the request concerns identity, ownership, or third-party control, terminate this Agreement. We may also require a live video call, screen share, or trading demonstration to confirm personal control of the account.
16. Termination
Either party may terminate this Agreement on seven calendar days' written notice. We may terminate immediately, without a notice period, for a hard breach, fraud, sanctions restriction, prohibited or abusive conduct, false or incomplete KYC or compliance information, third-party account operation, a chargeback or payment reversal, abusive conduct toward staff, or material non-payment. We may also terminate or reset the account where the product, platform, liquidity or data provider, or programme is withdrawn or materially changed, or where continuing would expose the programme, the platform, or our business to legal, regulatory, or reputational risk.
On termination, you must stop trading immediately, and we may close positions and cancel orders. Only a reward already approved in writing before the termination date is payable. Where we terminate for convenience without fault on your part, we will assess fairly any eligible profit through the effective cut-off under the Performance Reward Policy. No reward is due on fabricated, manipulated, prohibited, abusive, or non-qualifying activity, or where termination results from your conduct.
17. Taxes and Payment Details
You are responsible for tax status and liabilities. Reward details must belong to you unless we approve a lawful business payee after due diligence. We may deduct legally required withholding and reasonable payment-provider charges disclosed before payment.
18. Liability and Disputes
The General Terms' disclaimers, liability limits, complaints process, governing law, and jurisdiction apply. You may appeal a trading or reward decision under the Complaints and Appeals Policy. The parties will first try in good faith to resolve a formal complaint using that process without preventing urgent legal relief or mandatory rights.
Subject to mandatory law, our total liability to you under or in connection with this Agreement and the funded simulated account is limited to the fees paid by you to us for the related Order during the twelve months before the event giving rise to the claim. We are not liable for a reward that is withheld, reduced, denied, or recovered under this Agreement, for platform, provider, or connectivity failure, or for any indirect, consequential, or economic loss, including lost profit or lost opportunity. You agree to indemnify and hold harmless FUNDED IQ LLC, its officers, staff, and providers against any loss, cost, claim, and expense caused by your breach of this Agreement, abusive conduct, or false or misleading information.
19. Term and Survival
This Agreement starts at electronic acceptance and continues until the account and all pending reviews close. Confidentiality, intellectual property, data, taxes, accrued payments, liability, disputes, and records provisions survive to the extent needed for their purpose.
The rights in clauses 9 to 12, 15, 16, and 18 survive termination for any reason, including the right to deny, withhold, or recover a reward and to refuse further accounts.
20. Electronic Acceptance
By selecting the acceptance control or applying your electronic signature, you confirm that you have read, understood, and agreed to this Agreement, your Product Schedule, the Trading Rules, the Performance Reward Policy, and the documents incorporated through the General Terms and Conditions. Your Acceptance Record identifies the version, account, time, and authentication evidence for your signature.
